General Terms and Conditions (GTC)

Welcome to the PlayVR Funpark – Important Information for Your Visit 🎮

1. Scope of Application

​​​​

  • These General Terms and Conditions (GTC) apply to all business relationships between PlayVR Funpark GmbH and the customer. The version valid at the time of contract conclusion shall apply.

  • Consumers are consumers within the meaning of the Austrian Consumer Protection Act (KSchG) and therefore natural or legal persons who are not entrepreneurs. Entrepreneurs are natural persons or legally competent partnerships for whom the contract in question is part of their business operations. Enterprises are all long-term organizations of independent economic activity, even if not profit-oriented. Customers include both consumers and entrepreneurs.

  • Deviating, conflicting, or supplementary general terms and conditions shall not become part of the contract, even if known, unless their validity is expressly agreed to in writing. For voucher purchases, our Voucher Terms and Conditions also apply.

  • Our Usage Rules are binding and form an integral part of these GTC.

  • If the customer transfers their ticket to a third party, they must inform the third party of these GTC and the Usage Rules.


2. Booking & Contract Conclusion

  • Our offers are non-binding unless explicitly stated otherwise.

  • Customers may book tickets online or on-site. By booking, the customer submits a binding contract offer. The contract becomes valid once we confirm the booking.

  • Online: After payment, the customer receives a confirmation, which must be presented on-site.

  • On-site: After payment, the customer receives a ticket, which must be presented at the VR machines.

  • We reserve the right to reject bookings, e.g., if a visitor has violated our rules in the past.

  • Tickets cannot be returned (except for statutory withdrawal rights). Lost tickets will not be replaced.

  • Consumers may withdraw from an online booking within 14 days of contract conclusion, provided the service has not yet been used. Please see the cancellation policy and cancellation form attached.


3. Prices

  • All prices are stated in euros and include statutory VAT.

  • For online bookings, the current price list on our website applies; for on-site bookings, the current on-site price list applies.

  • We reserve the right to adjust prices.

  • Customers incur no additional costs for online bookings when using remote communication means.


4. Payment

​​​​

  • Payment is made using the payment methods available at the time of booking. Tickets are only issued after full payment.

  • For online bookings, we accept: MasterCard, Visa, VPay, ApplePay, GooglePay.

  • For on-site bookings, we accept cash or card payments. Delivery by post is not possible.


5. Admission

​​​

  • Tickets are valid only for the customer or the designated user.

  • Tickets must be shown upon request at any time.


6. Use of Attractions

​​​

  • Please read and follow our Usage Rules. They are binding and form an integral part of these GTC.

  • Always follow the instructions of our team.


7. Liability

​​​

  • Use of the facilities is at your own risk.

  • We are liable only for intentional or grossly negligent conduct, not for slight negligence. This does not apply to personal injury.

  • We are not liable for damages caused by third parties or force majeure.

  • Damages must be reported immediately.


8. Applicable Law & Jurisdiction

​​​

  • Austrian substantive law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

  • Place of performance is Vienna.

  • The competent court for 1010 Vienna is agreed as the place of jurisdiction for all disputes arising directly or indirectly from the contract.

  • For lawsuits against consumers residing, habitually living, or employed in Austria, one of the courts in the district of their residence, habitual abode, or place of employment shall have jurisdiction.

  • For lawsuits brought by consumers against us, the statutory place of jurisdiction applies.

10. Severability Clause

 

  • Should any provision of these GTC be invalid, the remainder shall remain valid. The invalid provision shall be replaced by a valid one that comes closest economically.

Voucher Terms and Conditions – PlayVR Funpark GmbH


1. Scope of Application 📜

  • These Terms and Conditions apply – in addition to our general GTC – to all business relationships between PlayVR Funpark GmbH and the customer when purchasing vouchers. The version valid at the time of contract conclusion applies.

  • Consumers are consumers within the meaning of the Austrian Consumer Protection Act (KSchG) and therefore natural or legal persons who are not entrepreneurs. Entrepreneurs are natural persons or legally competent partnerships for whom the contract in question is part of their business operations.   • If the customer transfers their voucher to a third party, they must inform the third party of these Terms and Conditions.


2. Purchase & Contract Conclusion 🛒

  • Vouchers can currently be purchased at the PlayVR Shop in Auhof Center.

  • By purchasing or using a voucher, you accept these Terms and Conditions.

  • Vouchers can be purchased by both consumers and entrepreneurs. For consumers, the Austrian Consumer Protection Act in its current version also applies.


3. Voucher Types 🎁

  • The PlayVR voucher card is available with any amount between €10 and €500.


4. Conditions for Voucher Cards ⚠️

​​​​​

  • Vouchers cannot be paid out in cash or exchanged for cash.

  • No replacement will be provided in the event of loss, theft, damage, illegibility, or unauthorized use.

  • Vouchers cannot be used to purchase additional vouchers.

  • Commercial or business resale is not permitted.

  • PlayVR reserves the right to offer vouchers in different formats.


5. Balance & Validity ⏳

  • Your current balance can be checked anytime at the PlayVR Shop in Auhof Center.

  • For partial redemptions, the remaining balance stays on the card.

  • Voucher cards are valid for 3 years from the date of purchase and can be reloaded.
